Geneva College is committed to acting in a manner consistent with our deeply held Christian beliefs. Accordingly, we filed a federal lawsuit on Tuesday, February 21, 2012 against the Obama administration’s unconstitutional mandate that religious employers provide insurance coverage for abortion-inducing drugs to employees and students regardless of religious or moral objections.
In June 2013, the court ruled that Geneva could offer students a health insurance plan that does not cover intrauterine devices or morning-after and week-after anti-pregnancy medications while the college continued to challenge the federal health care law that requires insurers to pay for such options. The government appealed that decision to the 3rd Circuit.
In February 2015, the 3rd Circuit’s decision in Geneva College v. Burwell forced Geneva to provide access to abortion pills as required by the Obama administration’s abortion-pill mandate.
In March 2015, Geneva asked the full U.S. Court of Appeals for the 3rd Circuit Monday to hear the case challenging that ruling.
In May 2015, the 3rd Circuit granted Geneva a temporary stay pending a response and further orders by the Supreme Court in Persico and Zubik.
In August 2015, Geneva filed a brief requesting the Supreme Court to review Geneva College v. Burwell.
On November 6, 2015, the Supreme Court agreed to consider Geneva’s case, along with seven similar cases.
Supported by the Alliance Defense Fund, we are pursuing this legal action to protect our ability to have health insurance coverage that does not violate our understanding of God-honoring behavior. We believe that this mandate is a violation of the freedoms of religion and free speech guaranteed by the Constitution of the United States and affirming legislation such as the Religious Freedom Restoration Act. Our suit is not directed at preventative contraception, but is about protecting us and other religious organizations from government mandates that require us to act against our convictions.
